1. Acceptance of terms

By accessing or using Interviewspilot.com (the “Service”), you (the “User”) agree to be bound by these Terms of Service (the “Terms”). If you do not agree to all the Terms, do not use the Service.

2. Eligibility

  1. Minimum Age: You must be at least 16 years old to use the Service.
  2. Accuracy of Information: You agree to provide truthful and accurate information during registration and to update such information if it changes.

3. Account creation

  1. Google Authentication You may sign up via Google. By doing so, you also agree to comply with Google’s Terms of Service.
  2. Account Security
    • You are responsible for maintaining the confidentiality of your login credentials.
    • You agree to notify us immediately at support@interviewspilot.com if you suspect any unauthorized access or use of your account.
    • We are not liable for any loss or damage arising from your failure to safeguard your login information.

4. Service description

  1. Purpose The Service provides AI-powered mock interviews, feedback, and practice tools.
  2. Disclaimer of Employment Outcomes
    • AI-generated feedback is intended for practice and informational purposes only.
    • No Guarantee: We do not guarantee that using the Service will lead to employment or specific job-related outcomes.
  3. Third-Party Dependencies
    • The Service may rely on third-party providers (e.g., Bubble.io, Stripe, Google, OpenAI).
    • Outages or disruptions caused by these providers are beyond our control.

5. Payments & subscriptions

Access to certain features of our service is provided through a monthly subscription model. Subscriptions are billed in advance on a recurring monthly basis. Each subscription renews automatically under the same conditions unless it is cancelled by the user or terminated by us.

  1. Stripe Payments
    • All subscription payments are processed via Stripe.
    • By using Stripe, you agree to Stripe’s Terms.
    • No Storage of Payment Data: We do not store your credit card details; Stripe handles all payment information.
  2. Subscription Renewals
    • Your subscription may renew automatically unless you cancel before the renewal date.
    • You can cancel at any time, and you will retain access until the end of your current billing cycle.
  3. No Refunds
    • All purchases are final once charged.
    • We do not offer refunds for partial use or unused subscription periods.
  4. Free Trials
    • We may offer a free plan at our discretion. We may revoke, remove or modify the free plan features at our discretion.

5.1 Cancelation policy

  1. You can cancel at any time, and you will retain access until the end of your current billing cycle.
  2. Your subscription may renew automatically unless you cancel before the renewal date.

5.2 Refund policy

Except as required by law, subscription fees are non-refundable. We encourage our users to utilize the free version of our service to ensure it meets their needs before subscribing to the paid version.

  • All purchases are final once charged.
  • We do not offer refunds for partial use or unused subscription periods.

5.3 Fees changes policy

Subscription fees are subject to change at our discretion. Any adjustments to subscription fees will be implemented at the start of the subsequent billing period. We commit to providing ample notice of any changes in fees, allowing you to cancel your subscription before the new fees are applied. Continued use of our service after a fee adjustment signifies your acceptance of the new subscription terms.

6. User responsibilities

By using the Service, you agree not to:

  1. Illegal Activities
    • Use the Service for any illegal purpose or to violate any applicable law.
  2. Harmful Content
    • Upload viruses, malware, or any harmful code.
    • Post or transmit content that is harassing, hateful, threatening, obscene, or otherwise objectionable.
  3. Misuse of the Service
    • Reverse-engineer, decompile, or otherwise tamper with the Service, its code, or its third-party integrations.
    • Interfere with the security or operation of the Service.
  4. Respect Intellectual Property
    • Use the AI-generated or platform-provided content only for lawful, personal use.
    • Do not claim ownership over content created by the Service.

7. Acceptable usage policy

While our Pro plan offers ‘unlimited questions’, this is subject to a fair usage policy to prevent abuse. Usage exceeding 500 questions per month may be considered excessive and could result in restrictions or the need for additional agreements. This policy helps us maintain service quality and availability for all users.

8. Third-party services

  1. Bubble.io
    • Our Service is built and hosted on Bubble.io. Any outages or technical issues originating from Bubble.io’s infrastructure are beyond our control.
  2. Stripe & Google
    • Payments and authentication are facilitated by Stripe and Google, respectively.
    • We are not liable for issues arising from their services or any modifications they make.
  3. OpenAI

9. Termination

  1. Right to Suspend or Terminate
    • We may suspend or terminate your account at any time if we believe, in our sole discretion, that you have violated these Terms or engaged in suspicious or abusive activity.
    • We may also restrict or terminate access to the Service for any reason without prior notice.
  2. Effect of Termination
    • Upon termination, your right to use the Service immediately ceases, and any data or content you provided may be deleted at our discretion.
    • We are not liable for any loss of data or content due to account suspension or termination.

10. Intellectual property

  1. Our Content
    • All content provided through the Service (including but not limited to AI-generated feedback, interview questions, text, images, logos, and software) is owned or licensed by us.
    • You are granted a limited, non-transferable, revocable license to use such content solely for your personal, non-commercial use in connection with the Service.
  2. Your Content
    • You retain ownership of any materials you upload to the Service (e.g., resumes, personal notes).
    • By uploading, you grant us a non-exclusive, worldwide, royalty-free license to process and display this content for the purpose of providing the Service.
  3. Feedback
    • Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation or compensation.

11. Disclaimer of warranties

  1. As-Is Basis
    • The Service is provided on an “as is” and “as available” basis.
    • We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  2. No Guarantee of Accuracy
    • We make no warranty that AI-generated feedback or interview simulations will be accurate, complete, or reliable.
  3. No Guarantee of Uninterrupted Service
    • We do not warrant that the Service will be free of errors, viruses, or interruptions.
    • We are not responsible for any data loss or damages arising from Service interruptions or downtime.

12. Limitation of liability

To the fullest extent permitted by law, we (and our officers, directors, employees, or affiliates) are not liable for:

  1. Indirect or Consequential Damages
    • Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
  2. Third-Party Actions
    • Issues arising from or caused by third parties (e.g., Stripe, Bubble.io, Google, OpenAI).
  3. AI-Generated Content
    • Inaccuracies, errors, or omissions in AI-powered mock interviews and feedback.
  4. User Negligence
    • Unauthorized access to your account due to your failure to maintain secure login credentials.

12.1 Liability Cap

  • Maximum Liability: Our total liability to you for any claim shall not exceed the greater of (a) the total fees paid by you to us in the past twelve (12) months or (b) $100 (or local equivalent).

12.2 Mediation First

  • You agree to attempt mediation to resolve any dispute before pursuing litigation.

13. Indemnification

You agree to indemnify and hold us (and our affiliates, officers, directors, and employees) harmless from any claim, demand, damages, liabilities, or expenses (including attorneys’ fees) arising out of:

  • Your violation of these Terms.
  • Your misuse of the Service or any integrations.
  • Your violation of any law or regulation.

14. GDPR & international data transfers

  1. Data Transfers
    • The Service may transfer and process data in countries outside of your place of residence.
    • For EU/EEA users, we rely on Standard Contractual Clauses or other lawful means to ensure data protection when transferring data internationally.
  2. OpenAI as Processor
    • When your data is processed by OpenAI, OpenAI acts as a data processor in certain jurisdictions under its Data Processing Addendum.
    • By using the Service, you acknowledge and accept these international data transfers.

15. Governing law & dispute resolution

  1. Governing Law
    • These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict-of-law provisions.
  2. Jurisdiction
    • You agree to submit to the personal jurisdiction of the courts located in Ontario, Canada, for any dispute arising out of or relating to these Terms or the Service.
  3. Mediation / Arbitration
    • If you are located in a jurisdiction that allows for alternative dispute resolution, the parties may choose mediation or binding arbitration.
    • Nothing in this section prevents either party from seeking preliminary injunctive relief in a court of competent jurisdiction.

16. Changes to terms

  1. Modification Rights
    • We reserve the right to update or modify these Terms at any time.
    • We will post the revised Terms on our website along with the “Last Updated” date.
  2. Acceptance of Changes
    • Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
    • If you do not agree to the new Terms, you must cease using the Service.

17. Entire agreement & severability

  1. Entire Agreement
    • These Terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and us regarding the Service.
  2. Severability
    • If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.
